When a stablecoin peg is challenged: what to do first

When your stablecoin's peg is publicly challenged, stop new issuance the same day, freeze marketing claims about the peg, and open the redemption channel described in your whitepaper. Notify your competent authority and legal counsel before any public statement. The regulator, not the market, decides whether your response was adequate.

What counts as a challenged peg

A peg is challenged in a few recurring situations. The token trades away from its reference value on a public exchange for more than a brief window. A counterparty, an auditor, or a market commentator disputes the composition of the reserve backing the token. A competent authority opens an informal inquiry into redemption capacity before any formal proceeding starts.

Each of these looks different from the inside. A trading discount is visible within hours. A disputed reserve claim can surface weeks after the underlying assets moved. A regulator's inquiry often arrives as a routine information request, not as an announcement, and treating it as routine is the first mistake most issuers make.

Legal basis

Two EU Regulations apply directly to an issuer operating in Lithuania or Estonia. Regulation (EU) 2023/1114 (MiCA) sets the framework for issuers of asset-referenced tokens and e-money tokens, including reserve composition, custody of reserve assets, and holders' right of redemption. Regulation (EU) 2023/1113 (TFR) governs the information that must accompany transfers of funds and crypto-assets, which becomes relevant the moment redemption volume spikes.

Both instruments entered into force on 30 December 2024. Neither Regulation states a fixed penalty amount that applies automatically to a peg dispute; enforcement depends on the facts your competent authority finds, not on a published tariff.

What changes in your risk and timeline

Once the peg is public knowledge, several clocks start running at once, and none of them pause for the dispute itself. Your redemption obligations do not stop because the cause of the discount is unclear. Regulatory attention intensifies quietly, well before any public enforcement step. Any delay in your response becomes part of the record a competent authority reviews later, whether or not that delay was reasonable at the time.

Public statements you make in the first day carry more evidential weight than statements made a week later, once counsel has reviewed the file. This is the main reason a rushed reassurance often causes more damage than a short delay for a checked statement.

What to do first

  1. Legal counsel confirms within hours whether the challenge concerns solvency, valuation, or a compliance gap — the correct response differs for each, and a single generic statement risks being wrong for one of the three.
  2. Treasury confirms that the redemption channel disclosed in the whitepaper is open and removes any manual delay on requests already in the queue.
  3. Compliance notifies the competent authority in the home Member State before any public statement is issued, even an informal one.
  4. Communications drafts a single factual statement, cleared by counsel, and holds off speculation about causes until the reserve position is confirmed.
  5. The board or management records the timeline of internal decisions from the first report of the challenge, including who was told and when.
  6. Compliance reviews outgoing transfer records under Regulation (EU) 2023/1113 (TFR) if redemption volume spikes, since a surge in transfers draws separate attention on its own.

Who decides

No single body owns a peg dispute from start to finish. Different aspects of the same event go to different decision points, and mixing them up in your own response is a common source of delay.

SituationDeciding bodyWhat it typically weighs
Redemption request unmetIssuer's internal complaints process, then the competent authority in the home Member StateWhether the redemption channel was open and the request was processed within the terms disclosed to holders
Reserve composition disputedCompetent authority under MiCA supervisionReserve records, custody arrangements, and the disclosures made before the dispute became public
Transfer information disputedThe service provider's own AML function, then its supervisorWhether the information accompanying the transfer met the applicable requirements at the time it moved

None of these bodies decides on the basis of the market price alone. A price discount is evidence that something is being questioned; it is not, by itself, the finding.

If your situation differs

If redemption requests already exceed the liquid part of your reserve, the priority shifts from public reassurance to an orderly queue and a prompt disclosure to the competent authority. A queue that is disclosed early looks very different, on the record, from one discovered later.

If the challenge comes from one vocal counterparty rather than the broader market, a documented factual response addressed to that counterparty can resolve the matter without a public statement at all. Escalating to the public before trying this step is usually premature.

If a competent authority has already opened an inquiry, every subsequent public statement should be checked against the scope of that inquiry before release, since a statement that contradicts information already given to the regulator creates a separate problem of its own.

What this page does not solve

This page does not resolve a specific redemption dispute, size an actual reserve shortfall, or draft the public statement itself. Each of those depends on the facts in your file, not on a general procedure.

If you are named in a report and the data used against you appears inaccurate, that is a separate procedure from the peg dispute, and it runs on its own timeline, independent of what your regulator decides.

Some counterparties respond to a challenged peg by ordering due diligence on the issuer before continuing to trade with it. Counterparty in Spain and its limits sets out what such a check can and cannot establish, and where its findings stop.

A parallel check often covers the documents the issuer relies on to support its reserve claims. Document in Spain and its limits explains what a document verification can confirm and what it leaves open.

Where a counterparty or a reserve custodian happens to be registered also affects what can be verified about it. Jurisdiction in Spain and its limits covers the limits of a jurisdiction search on that point.

Common mistakes at this stage

Issuers under pressure tend to repeat the same handful of mistakes. Issuing a public reassurance before treasury has confirmed the redemption channel is open creates a statement that can be disproved within a day. Treating a regulator's information request as a formality, rather than as the start of a file that will be reviewed later, removes the chance to shape that file early. Waiting for the market discount to close on its own, instead of documenting the internal response as it happens, leaves a gap in the record that is hard to fill retroactively.

A challenged peg is a procedural event before it is a public relations event. The order in which you take these steps matters more than how quickly you take the first one.

FAQ

What is the first step when a stablecoin peg is challenged?

Stop new issuance and confirm that the redemption channel described in your whitepaper is genuinely open, before any public statement is drafted or released.

Which deadline is already running?

The deadline on any unmet redemption request is already running from the moment a holder submits it. It does not pause while the market dispute over the peg is unresolved.

Who decides, and on what evidence?

The competent authority in your home Member State decides, weighing your reserve records, custody arrangements, and the disclosures you made to holders before the dispute became public.
