Stay pending validity: costs drivers

A stay pending validity pauses the main patent dispute until a separate challenge to the patent's validity is resolved. The pause itself is free. What drives the cost is the length of the wait, the number of parallel filings it creates, and the work needed to keep evidence and experts ready for resumption.

Why validity triggers a pause

When a party challenges the patent that underlies an infringement claim, the forum hearing the infringement action often has no reason to continue before knowing whether the patent survives. Continuing risks a judgment built on a right that later disappears. Pausing risks letting an infringement continue unchecked. The decision-maker weighs both risks case by case.

The trigger is procedural, not substantive: a validity challenge has to exist somewhere — before an office, a board, or a court — before a stay can be requested. Ownership disputes over the same patent complicate matters further. Where a contract left ownership unclear, a validity stay can stall behind an ownership dispute, as described in When the contract says work for hire and nothing.

What drives the cost

FactorEffect on cost
Number of parallel proceedingsEach additional forum adds its own filings and its own timetable
Stage the validity challenge has reachedAn early-stage challenge means a longer, less predictable wait
Technical complexity of the patentExpert reports are commissioned once, then held ready for months
Translation needsMulti-jurisdiction disputes duplicate document sets in each language
Monitoring during the staySomeone has to track the validity forum's docket without billing for idle time
Resumption workEvidence and witnesses often need refreshing before the main case restarts

Stages, documents and timing

  1. File the stay request with the forum hearing the main dispute, naming the parallel validity proceeding.
  2. Submit the validity filing itself, or evidence that one already exists, as the basis for the request.
  3. Respond to the other side's position on whether a stay is warranted.
  4. Wait for the decision-maker's ruling on the stay — granted, refused, or granted subject to conditions.
  5. Monitor the validity proceeding until it concludes, then apply to lift the stay and resume the main case.

Documents typically needed: the main claim or defence, proof that a validity challenge is pending, and a short statement of why the outcome of that challenge would change the main case. Where the same dispute also involves an online enforcement step, that step runs on its own track. See Take-down and delisting procedure step by step in detail for how a decision-maker there assesses removal requests.

Who decides, and how long it takes

The forum already seized of the main dispute decides the stay request — it does not need a separate application to a different body. Timing depends on that forum's own docket. A straightforward request can be decided within weeks. A contested one, where the other side argues the stay is a delay tactic, takes longer because both sides file submissions first.

The point of no return sits at the moment the main forum issues its stay order. After that, most of the case activity moves to the validity proceeding, and the main case stays administratively open but inactive until someone applies to lift the order.

Forks

If a validity challenge is already filed elsewhere, the stay request is straightforward: attach the filing and explain the overlap.

If no challenge has been filed yet, the forum will usually want to see it filed first, or filed very shortly after the stay request, before granting a pause.

If the other side does not respond to the stay request within the time set by the forum, most forums treat the silence as no objection and decide on the papers filed.

Sources and limit

This page covers the mechanics of the pause: who requests it, who decides it, and what keeps costs moving during it. It does not set a duration, a document count, or a working estimate for a specific file. That depends on the forum, the number of jurisdictions involved, and whether a settlement route is already open.

Estimating a specific file against these drivers is a scoping exercise, not a general answer, and sits in the product layer rather than here. A jurisdiction-specific counterparty check, useful where a stay involves a foreign party, is illustrated in Counterparty in France in detail.

Questions we are asked

How long does stay pending validity take in practice?

It runs as long as the validity proceeding it depends on. A challenge before a fast administrative board can resolve in months; one that reaches a final court decision after appeal can take years. The stay itself adds little time beyond that dependency.

Which documents are needed to start?

A copy of the main claim, proof that a validity challenge exists or is about to be filed, and a short explanation of why that challenge's outcome would change the main case's result.

What happens if the other side does not respond?

Most forums decide on the papers already filed and treat silence as no objection, rather than waiting indefinitely for a reply.
