Opposition settlement: stages and deadlines
Opposition settlement is the route parties take to end an EU trade mark opposition by agreement instead of by decision. It runs through three stages: a cooling-off period, direct negotiation, and a filing stage where the parties record what they agreed. The clock does not stop for informal talks — every extension has to be requested and confirmed before the running deadline expires, or the file moves on without you.
How the settlement track sits inside the opposition
Once an opposition is filed and served, the office opens a window during which the parties can talk without the adversarial clock running against them. That window is not indefinite. Either side, or both together, can ask for it to be extended, but the request has to reach the office before the current window closes — a request filed after the deadline has already lapsed changes nothing.
A settlement agreement is a contract, and it inherits ordinary contract-drafting risk. Exit mechanics, notice periods, and remedies for a broken undertaking all need the same care as in any commercial agreement, including how either side would unwind it early — the logic sits close to Termination for convenience clauses used in ordinary supply contracts. Treat the settlement document as a contract first and a procedural filing second.
| Stage | What happens | Who moves it forward |
|---|---|---|
| Cooling-off | Adversarial deadlines are suspended so the parties can talk | Either party, jointly or separately, by written request |
| Negotiation | Terms are proposed, revised, and recorded in writing | The parties and their representatives |
| Filing | Withdrawal, amendment, or consent is lodged with the office | The applicant or opponent, through its filing team |
| Confirmation | The office updates the file status accordingly | The office, on receipt of a compliant filing |
What to do
- Request the cooling-off period promptly, in writing, once the opposition notice is served — the applicant or its representative files this.
- Open direct contact with the opposing party or its representative while the period runs, and put every proposal in writing as you go.
- Draft the settlement terms as a standalone written agreement covering scope, any coexistence conditions, and conduct undertakings; counsel typically leads this stage.
- File the resulting withdrawal, amendment, or consent with the office before the current deadline expires; the filing team executes this administratively.
- Confirm the office has updated the file status before treating the matter as closed; the case handler on your side checks this.
Who decides, and on what timeline
The office manages the calendar and checks whether an extension request meets its formal requirements. It does not mediate the negotiation itself and takes no view on the commercial terms. If no settlement filing reaches it before the cooling-off period lapses, the file moves automatically into the adversarial stage, and the standard evidence and argument deadlines start running again as if the talks had never opened.
Common forks
If the other side simply stops responding once talks reach a difficult point, the file does not wait for them: the cooling-off period still lapses on schedule, and the case reverts to the adversarial track described in Opposition proceedings: what the decision maker looks at.
If the opposing party is already contesting a separate claim elsewhere — the pattern is close to A supplier refuses an indemnity patent when the other side has already moved — settlement leverage in the trade mark file often tracks how that other dispute is going, and it pays to check before making an offer.
If the portfolio at stake includes a tokenised brand extension, redemption mechanics can complicate a coexistence settlement in ways a standard agreement does not anticipate: see How redemption process design token issuance documents to prepare for the separate document set that applies there.
Sources and limit
This page maps the settlement track only. It does not size the cost exposure of a drawn-out opposition, and it does not replace a review of the wider portfolio sitting behind the disputed mark — where that mark forms part of a deal already in motion, see Asset report before a portfolio is bought in detail for how that review runs alongside a live opposition.
Procedures and internal deadlines set by the office change from time to time. This page was checked against current case-handling practice at the office; confirm the live deadlines in your own file before acting on any date mentioned here.

FAQ
How long does opposition settlement take in practice?
There is no fixed length. It runs for as long as the cooling-off period plus every extension the parties jointly request, so the practical duration depends on how many extensions get filed and how quickly terms get agreed.
Which documents are needed to start?
At minimum: the request for the cooling-off period itself, proof of authority for whoever is negotiating, a draft settlement agreement once terms firm up, and the final withdrawal, amendment, or consent form lodged with the office.
What happens if the other side does not respond?
The cooling-off period still lapses on schedule regardless of silence. Without a joint extension request or a filed settlement, the file moves back onto the standard adversarial timetable automatically.
